You can recognize an encrypted connection by the character string "https://" and the lock symbol in your browser line.

2) Data collection when visiting our websites

When using our website for informational purposes only, i.e. if you do not register or otherwise transmit information to us, we only collect data that your browser transmits to our server (so-called "server log files"). When you visit our website, we collect the following data, which is technically necessary for us to display the website to you:

  • Our visited website
  • Date and time of access
  • Amount of data sent in bytes
  • Source/reference from which you came to the page
  • Browser used
  • Operating system used

Processing is carried out in accordance with Art. 6 (1) lit. f GDPR based on our legitimate interest in improving the stability and functionality of our website. The data will not be passed on or used otherwise. However, we reserve the right to check the server log files retrospectively if there are concrete indications of illegal use.

3) Cookies

To make visiting our website attractive and to enable the use of certain functions, we use so-called cookies on various pages. These are small text files that are stored on your end device. Some of the cookies we use are deleted after the end of the browser session, i.e. after you close your browser (so-called session cookies). Other cookies remain on your end device and enable us or our partner companies (third-party cookies) to recognize your browser on your next visit (persistent cookies). If cookies are set, they collect and process certain user information such as browser and location data and IP address values to an individual extent. Persistent cookies are automatically deleted after a specified period, which may vary depending on the cookie.

If personal data is also processed by individual cookies implemented by us, the processing is carried out either in accordance with Art. 6 (1) lit. b GDPR for the performance of the contract or in accordance with Art. 6 (1) lit. f GDPR to safeguard our legitimate interests in the best possible functionality of the website and a customer-friendly and effective design of the website visit.

We may work with advertising partners who help us make our website more interesting for you. For this purpose, in this case, cookies from partner companies (third-party cookies) are also stored on your hard drive when you visit our website. If we cooperate with the aforementioned advertising partners, you will be informed individually and separately about the use of such cookies and the scope of the information collected in the following paragraphs.

Please note that you can set your browser so that you are informed about the setting of cookies and can decide individually whether to accept them or to exclude the acceptance of cookies for certain cases or in general. Each browser differs in the way it manages cookie settings. This is described in the help menu of each browser, which explains how you can change your cookie settings. 4) Contacting us

When you contact us (e.g. via contact form or e-mail), personal data is collected. Which data is collected in the case of using a contact form can be seen from the respective contact form. This data is stored and used exclusively for the purpose of answering your request or for contacting you and the associated technical administration. The legal basis for processing this data is our legitimate interest in answering your request in accordance with Art. 6 (1) lit. f GDPR. If your contact aims at concluding a contract, the additional legal basis for processing is Art. 6 (1) lit. b GDPR. Your data will be deleted after your request has been fully processed. This is the case if it can be inferred from the circumstances that the matter in question has been conclusively clarified and provided that there are no statutory retention obligations to the contrary.

5) Comment function

In addition to your comment, the comment function on this website also stores and publishes information about the time the comment was created and the commenter name you chose. Furthermore, your IP address is logged and stored. This storage of the IP address is for security reasons and in the event that the person concerned violates the rights of third parties or posts illegal content through a comment. We need your e-mail address to contact you if a third party should object to your published content as illegal. The legal bases for storing your data are Art. 6 (1) lit. b and f GDPR. We reserve the right to delete comments if they are objected to by third parties as illegal.

6) Use of customer data for addressing existing customers

6.1 Receiving relevant information and useful offers related to the purchase of goods

By purchasing our goods and the existing business contact, you agree to regularly receive relevant information and useful offers closely related to the purchase of your goods via e-mail. Consent in accordance with the requirements of Section 7 (3) UWG expires with a revocation addressed to hello@mcbrikett.de. You can also unsubscribe from our information letter at any time via the link provided in the e-mail or by sending a corresponding message to the controller mentioned at the beginning. After unsubscribing, your e-mail address will be immediately deleted from our e-mail distribution list, unless you have expressly consented to further use of your data or we reserve the right to further data use that is legally permitted and about which we inform you in this declaration.

6.2 E-mail dispatch via Quentn

Our e-mails are sent via the technical service provider Quentn, to whom we pass on the data provided. This transfer takes place in accordance with Art. 6 (1) lit. f GDPR and serves our legitimate interest in using an effective, secure and user-friendly e-mail system. The data you enter for the purpose of purchase (e.g. e-mail address) will be stored on Quentn's servers in Germany.

Quentn uses this information to send and statistically evaluate the e-mails on our behalf. For evaluation, the e-mails sent contain so-called web beacons or tracking pixels, which are single-pixel image files stored on our website. This allows us to determine whether a message has been opened and which links may have been clicked. Technical information is also collected (e.g. time of retrieval, IP address, browser type and operating system). The data is collected exclusively pseudonymized and is not linked to your other personal data; direct personal identifiability is excluded. This data is used exclusively for the statistical analysis of e-mail campaigns. The results of these analyses can be used to better adapt future e-mails to the interests of the recipients. If you wish to object to data analysis for statistical evaluation purposes, you must unsubscribe from the e-mails.

Furthermore, Quentn may use this data in accordance with Art. 6 (1) lit. f GDPR itself based on its own legitimate interest in the needs-based design and optimization of the service as well as for market research purposes, for example to determine from which countries the recipients come. However, Quentn does not use the data of our recipients to write to them themselves or to pass them on to third parties.

We have concluded an order processing agreement with Quentn, with which we oblige Mailchimp to protect our customers' data and not to pass it on to third parties.

You can view Quentn's privacy policy here: https://quentn.com/de/datenschutz

7) Use of Social Media: Videos

Use of YouTube videos

This website uses the YouTube embedding function to display and play videos from the provider "YouTube", which belongs to Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google").

The extended data protection mode is used here, which, according to the provider, only initiates the storage of user information when the video(s) are played. If the playback of embedded YouTube videos is started, the provider "YouTube" uses cookies to collect information about user behavior. According to "YouTube", these are used, among other things, to record video statistics, improve user-friendliness and prevent abusive practices. If you are logged in to Google, your data will be directly assigned to your account when you click on a video. If you do not wish the assignment with your profile on YouTube, you must log out before activating the button. Google stores your data (even for users who are not logged in) as usage profiles and evaluates these. Such an evaluation is carried out in particular in accordance with Art. 6 (1) lit. f GDPR on the basis of Google's legitimate interests in the display of personalized advertising, market research and/or needs-based design of its website. You have a right to object to the creation of these user profiles, whereby you must address YouTube to exercise this right. Within the framework of the use of YouTube, personal data may also be transmitted to the servers of Google LLC. in the USA.
Regardless of the playback of the embedded videos, a connection to the Google network is established each time this website is accessed, which can trigger further data processing operations without our influence.

Further information on data protection at "YouTube" can be found in the YouTube terms of use at https://www.youtube.com/static?template=terms and in Google's privacy policy at https://www.google.de/intl/de/policies/privacy.

Insofar as legally required, we have obtained your consent for the data processing described above in accordance with Art. 6 (1) lit. a GDPR. You can revoke your given consent at any time with effect for the future. To exercise your revocation, deactivate this service in the "Cookie Consent Tool" provided on the website.

8) Online Marketing

8.1 Facebook Pixel for creating Custom Audiences with extended data matching
Within our online offering, the so-called "Facebook Pixel" of the social network Facebook is used in extended data matching mode, operated by Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland ("Facebook").
Based on explicit consent, when a user clicks on an advertisement placed by us on Facebook, Facebook Pixel adds an additional parameter to the URL of our linked page. This URL parameter is then written into the user's browser via a cookie after redirection, which our linked page itself sets. Additionally, this cookie collects specific customer data, such as email addresses, that we gather on our website linked to the Facebook advertisement during processes like purchase completions, account registrations, or sign-ups (extended data matching). The cookie is then read by Facebook Pixel and enables the forwarding of data, including specific customer data, to Facebook.
With the help of the Facebook Pixel with extended data matching, Facebook is able, on the one hand, to precisely determine the visitors of our online offering as a target group for displaying ads (so-called "Facebook Ads"). Accordingly, we use the Facebook Pixel with extended data matching to display the Facebook Ads placed by us only to those Facebook users who have shown an interest in our online offering or who exhibit certain characteristics (e.g., interests in specific topics or products determined by the websites visited), which we transmit to Facebook (so-called "Custom Audiences"). With the help of the Facebook Pixel with extended data matching, we also want to ensure that our Facebook Ads correspond to the potential interests of the users and do not appear annoying. This also allows us to evaluate the effectiveness of Facebook Ads for statistical and market research purposes by tracking whether users were redirected to our website after clicking on a Facebook Ad (so-called "conversion"). Compared to the standard version of Facebook Pixel, the extended data matching feature helps us better measure the effectiveness of our advertising campaigns by capturing more attributed conversions.
All transmitted data is stored and processed by Facebook, allowing a connection to the respective user profile, and Facebook can use the data for its own advertising purposes, in accordance with Facebook's Data Policy (https://www.facebook.com/about/privacy/). The data can enable Facebook and its partners to display advertisements on and off Facebook.
These processing operations only take place upon explicit consent in accordance with Art. 6 para. 1 lit. a GDPR.
Consent to the use of the Facebook Pixel may only be given by users who are older than 13 years of age. If you are younger, we ask you to ask your guardians for permission.
The information generated by Facebook is usually transmitted to a Facebook server and stored there, which may also involve transmission to the servers of Facebook Inc. in the USA. You can revoke your consent at any time by deactivating Facebook Pixel tracking. For this purpose, you can set an opt-out cookie by clicking on the link below, which deactivates Facebook Pixel tracking: Deactivate Facebook Pixel
This opt-out cookie only works in this browser and only for this domain. If you delete your cookies in this browser, you must click the link above again.

8.2 Google AdSense

This website uses Google AdSense, a web advertising service of Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google"). Google AdSense uses so-called cookies, which are text files placed on your computer that enable an analysis of your use of the website. In addition, Google AdSense also uses so-called "web beacons" (small invisible graphics) to collect information, through the use of which simple actions such as visitor traffic on the website can be recorded, collected, and evaluated. The information generated by the cookie and/or web beacon (including your IP address) about your use of this website is usually transmitted to a Google server and stored there. This may also involve transmission to the servers of Google LLC. in the USA.

Google uses the information thus obtained to evaluate your user behavior with regard to the AdSense ads. The IP address transmitted by your browser as part of Google AdSense will not be merged with other Google data. The information collected by Google may be transferred to third parties if this is legally required and/or if third parties process this data on behalf of Google.

The described data processing takes place in accordance with Art. 6 Para. 1 lit. f GDPR for the purpose of targeted advertising to the user by third-party advertisers, whose advertisements are displayed on this website based on the evaluated user behavior. This processing also serves our financial interest in exploiting the economic potential of our online presence through the paid display of personalized third-party advertising content.

You can find more information about Google's privacy policy at the following internet address: https://www.google.de/policies/privacy/

You can permanently deactivate cookies for ad preferences by preventing them through a corresponding setting in your browser software or you can download and install the browser plug-in available at the following link: https://www.google.com/settings/ads/plugin?hl=de

Please note that if you have deactivated the use of cookies, certain functions of this website may not be fully available or may be limited.

To the extent legally required, we have obtained your consent for the aforementioned processing of your data in accordance with Art. 6 para. 1 lit. a GDPR. You can revoke your given consent at any time with effect for the future. To exercise your revocation, please follow the aforementioned option for making an objection.

9) Web analytics services

Google (Universal) Analytics
This website uses Google (Universal) Analytics, a web analytics service provided by Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google"). Google (Universal) Analytics uses so-called "cookies", which are text files stored on your device that enable an analysis of your use of the website. The information generated by the cookie about your use of this website (including the shortened IP address) is usually transmitted to a Google server and stored there, which may also involve transmission to the servers of Google LLC. in the USA.
This website uses Google (Universal) Analytics exclusively with the "_anonymizeIp()" extension, which ensures the anonymization of the IP address by shortening it and excludes direct personal identification. Through this extension, your IP address is truncated by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a server of Google LLC. in the USA and truncated there. On our behalf, Google will use this information to evaluate your use of the website, to compile reports on website activity, and to provide us with other services related to website and internet use. The IP address transmitted by your browser within the scope of Google (Universal) Analytics will not be merged with other Google data.
Through a special function, the so-called "demographic characteristics," Google Analytics also enables the creation of statistics with statements about the age, gender, and interests of page visitors based on an evaluation of interest-based advertising and with the involvement of third-party information. This allows the definition and differentiation of user groups of the website for the purpose of optimizing the target group alignment of marketing measures. However, datasets collected via the "demographic characteristics" cannot be assigned to a specific person.
All processing described above, in particular the setting of Google Analytics cookies for reading information on the used device, will only be carried out if you have given us your express consent in accordance with Art. 6 para. 1 lit. a GDPR. Without this consent, Google Analytics will not be used during your visit to the page.
You can revoke your given consent at any time with effect for the future. To exercise your revocation, please deactivate this service in the "Cookie Consent Tool" provided on the website. We have concluded a data processing agreement with Google for the use of Google Analytics, which obliges Google to protect the data of our page visitors and not to pass it on to third parties.
For the transfer of data from the EU to the USA, Google relies on so-called standard contractual clauses of the European Commission, which are intended to ensure compliance with the European level of data protection in the USA.
Further information on Google (Universal) Analytics can be found here: https://policies.google.com/privacy?hl=de&gl=de

Matomo Analytics

We use Matomo Analytics, an open-source web analytics service (formerly known as Piwik), on our website. Matomo uses cookies, which are stored on your computer and enable an analysis of your use of the website. The information generated by the cookie about your use of this website is stored on our own server and is not shared with third parties.

The storage of Matomo cookies is based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in the anonymized analysis of user behavior in order to optimize both its web offering and its advertising.

The information generated by the cookie about the use of this website will not be disclosed to third parties. You can prevent the storage of cookies by a corresponding setting in your browser software; however, we point out that in this case, you may not be able to use all functions of this website to their full extent.

If you do not agree with the storage and use of your data, you can deactivate the storage and use here

You have the option to prevent actions taken by you here from being analyzed and linked. This will protect your privacy, but will also prevent the owner from learning from your actions and improving usability for you and other users.

In this case, an opt-out cookie will be placed in your browser, which prevents Matomo from storing usage data. If you delete your cookies, this will also result in the Matomo opt-out cookie being deleted. The opt-out must therefore be reactivated when you visit our site again.

10) Tools and Other

– Google Web Fonts
This site uses so-called web fonts provided by Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google") for the uniform display of fonts. When you open a page, your browser loads the required web fonts into your browser cache to display texts and fonts correctly.
For this purpose, the browser you use must connect to Google's servers. This may also involve the transfer of personal data to Google LLC.'s servers in the USA. In this way, Google becomes aware that our website has been accessed via your IP address. The use of Google Web Fonts is in the interest of a uniform and appealing presentation of our online offerings. This represents a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR. If your browser does not support web fonts, a standard font from your computer will be used. Further information on Google Web Fonts can be found at https://developers.google.com/fonts/faq and in Google's privacy policy: https://www.google.com/policies/privacy/

11) Rights of the Data Subject

11.1 The applicable data protection law grants you comprehensive data subject rights (rights of access and intervention) with regard to the processing of your personal data by the controller, about which we inform you below:

  • Right of access in accordance with Art. 15 GDPR: In particular, you have a right to obtain information about your personal data processed by us, the purposes of processing, the categories of personal data processed, the recipients or categories of recipients to whom your data has been or will be disclosed, the planned storage period or the criteria for determining the storage period, the existence of a right to rectification, erasure, restriction of processing, objection to processing, complaint to a supervisory authority, the origin of your data if it has not been collected from you by us, the existence of automated decision-making including profiling and, if applicable, meaningful information about the logic involved and the significance and envisaged consequences of such processing for you, as well as your right to be informed about what safeguards pursuant to Art. 46 GDPR are in place when your data is transferred to third countries;
  • Right to rectification in accordance with Art. 16 GDPR: You have a right to immediate rectification of inaccurate data concerning you and/or completion of your incomplete data stored by us;
  • Right to erasure in accordance with Art. 17 GDPR: You have the right to request the erasure of your personal data if the conditions of Art. 17 para. 1 GDPR are met. However, this right does not exist, in particular, if the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise, or defense of legal claims;
  • Right to restriction of processing in accordance with Art. 18 GDPR: You have the right to request the restriction of the processing of your personal data as long as the accuracy of your data contested by you is being verified, if you refuse the erasure of your data due to unlawful data processing and instead request the restriction of the processing of your data, if you need your data for the establishment, exercise or defense of legal claims, after we no longer need this data after the purpose has been achieved or if you have objected to the processing for reasons relating to your particular situation, as long as it has not yet been determined whether our legitimate grounds override;
  • Right to notification in accordance with Art. 19 GDPR: If you have asserted the right to rectification, erasure, or restriction of processing against the controller, the controller is obliged to notify all recipients to whom the personal data concerning you has been disclosed of this rectification or erasure of the data or restriction of processing, unless this proves impossible or involves disproportionate effort. You have the right to be informed about these recipients.
  • Right to data portability in accordance with Art. 20 GDPR: You have the right to receive your personal data, which you have provided to us, in a structured, commonly used, and machine-readable format or to request transmission to another controller, insofar as this is technically feasible;
  • Right to revoke given consents in accordance with Art. 7 para. 3 GDPR: You have the right to revoke a once given consent to the processing of data at any time with effect for the future. In the event of revocation, we will immediately delete the data concerned, unless further processing can be based on a legal basis for processing without consent. The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent until revocation;
  • Right to lodge a complaint in accordance with Art. 77 GDPR: If you believe that the processing of personal data concerning you infringes the GDPR, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, your place of work or the place of the alleged infringement, without prejudice to any other administrative or judicial remedy.

11.2 Right to object

If we process your personal data based on our overriding legitimate interest in the context of a balancing of interests, you have the right to object to this processing with effect for the future at any time, on grounds relating to your particular situation.
If you exercise your right to object, we will stop processing the data concerned. Further processing remains reserved, however, if we can demonstrate compelling legitimate grounds for the processing that outweigh your interests, fundamental rights, and freedoms, or if the processing serves to assert, exercise, or defend legal claims.

If your personal data is processed by us for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for the purpose of such marketing. You can exercise your right to object as described above.

If you exercise your right to object, we will stop processing the data concerned for direct marketing purposes.

12) Duration of the storage of personal data

The duration of the storage of personal data is determined by the respective legal basis, the purpose of processing and – if applicable – additionally by the respective statutory retention period (e.g. commercial and tax law retention periods).

When personal data is processed on the basis of explicit consent in accordance with Art. 6 Para. 1 lit. a GDPR, this data is stored until the data subject withdraws their consent.

If there are statutory retention periods for data that are processed within the scope of legal or quasi-legal obligations on the basis of Art. 6 Para. 1 lit. b GDPR, this data will be routinely deleted after the expiry of the retention periods, provided that they are no longer required for the fulfillment or initiation of a contract and/or we no longer have a legitimate interest in continued storage.

When personal data is processed on the basis of Art. 6 Para. 1 lit. f GDPR, this data is stored until the data subject exercises their right to object in accordance with Art. 21 Para. 1 GDPR, unless we can demonstrate compelling legitimate grounds for the processing which outweigh the interests, rights and freedoms of the data subject, or the processing serves to assert, exercise or defend legal claims.

When personal data is processed for direct marketing purposes on the basis of Art. 6 Para. 1 lit. f GDPR, this data is stored until the data subject exercises their right to object in accordance with Art. 21 Para. 2 GDPR.

Unless otherwise stated in the other information in this declaration on specific processing situations, stored personal data will otherwise be deleted when they are no longer necessary for the purposes for which they were collected or otherwise processed.
